Chief George Gast of the Niagara Frontier Transportation Authority Police Department tells Cheektowaga Chronicle that Lawrence J. Penna, 68, of Williamsville was arrested and charged with leaving the scene of a fatal accident.

Gast said that Penna’s vehicle came in contact with the pickup truck causing it crash and roll over onto its roof.

He was arraigned in Cheektowaga Town Court Thursday morning where he pled not guilty. He was remained to jail until he posts $50,000 cash or a $100,000 bond.

The crash happened on the public ring road near the Genesee Street/Kensington Expressway exit around 11:45 p.m. Wednesday.

One person died in the crash.  Four people were transported to Erie County Medical Center by American Medical Response for treatment.  One was a Buffalo resident, three others are from out of state.

“Police officers and fire personnel did have to lift the pickup truck slightly because one of the individual’s arm was trapped under the rolled over vehicle.  Once they lifted the truck up all those survivors were able to crawl out of the truck,” said Chief George Gast.

“We will be conducting a complete and thorough investigation of this accident to determine the cause,” said Gast.  “Right now it appears to be a single-vehicle accident but that will be thoroughly determined after the accident investigation.”

Gast said additional charges are pending against Penna and the District Attorney’s Office and the NFTA police are working to see if charges could be filed against the pickup truck driver.

The Buffalo Airport Fire Department and U-Crest Fire Department attended to the scene.

Mr. Penna was scheduled to appear in Cheektowaga Court on June 14th but that date has been adjourned until July 5th.
