CHEEKTOWAGA, N.Y. – Defense attorney Joel Daniels says an Erie County grand jury has returned an indictment formally charging his client with killing his father.
SirWilliam Hardy was in Cheektowaga Town Court Friday morning when Erie County Assistant District Attorney Michael Smith told Judge Gorski that the grand jury took action this week in the case.
The indictment has been returned according to defense attorney Joel Daniels and Hardy is expected to be arraigned in Erie County Court next week.
Hardy’s case was adjourned on April 6th so that a forensic examination could be performed. Smith told Judge Gorski that forensic examiner’s office is requesting an additional two weeks to perform the exam.
“Forensic exams sometime take quite a while until they could be arraigned. The forensic examiner’s office, they’re very, very busy these days so we knew that it may take some additional time to do this,” said Attorney Joel Daniels.
“Ms. Cheryl Meyers-Buth and I are still in the process of determining whether we think a forensic may be required, may be appropriate here and we expect to report to the court on that next week at the arraignment,” added Daniels.
